1. Agreement to Terms

By accessing or using AptAlert NYC ("the Service"), operated by SA Consulting AEP LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

AptAlert NYC is a subscription-based apartment listing alert service that monitors multiple sources (including Craigslist, StreetEasy, and LeaseBreak) for apartment listings in the New York City metropolitan area and sends alerts to users based on their configured search criteria via email, SMS, and/or Telegram.

3. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

4.1 Plans

We offer Free, Pro ($19/month), and Premium ($29/month) plans. Plan features, pricing, and limits are described on our Pricing page and may change with reasonable notice.

4.2 Billing

  • Payments are processed securely through Stripe.
  • Subscriptions are billed monthly on the anniversary of your subscription date.
  • All prices are in US Dollars (USD).
  • You authorize us to charge your payment method for the applicable fees.

4.3 Cancellation and Refunds

  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of the current billing period.
  • No refunds are provided for partial billing periods.
  • Upon cancellation, your account will revert to the Free plan.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other users' accounts or our systems
  • Use automated scripts, bots, or crawlers to access the Service (beyond our provided API)
  • Resell, redistribute, or commercially exploit the Service or its data
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam, phishing, or unsolicited communications
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Circumvent any plan limitations or access controls

6. Listing Data and Third-Party Content

  • Apartment listings are sourced from third-party platforms. We do not own, verify, or guarantee the accuracy of listing data.
  • Listing availability, pricing, and details may change without notice.
  • We are not a real estate broker, landlord, or property manager.
  • We do not guarantee the availability of any apartment or the outcome of any rental application.
  • You are responsible for independently verifying all listing information before making any decisions.

7. Web Scraping and Data Sources

  • The Service aggregates publicly available apartment listing data from third-party platforms including Craigslist, StreetEasy, and LeaseBreak.
  • We access only publicly available information and do not circumvent any access controls or authentication mechanisms.
  • We are not affiliated with, endorsed by, or sponsored by Craigslist, StreetEasy, LeaseBreak, or any other third-party platform.
  • Listing data is provided "as is" from public sources. We make no representations regarding the accuracy, completeness, legality, or timeliness of any listing information.
  • Third-party platforms may change their data availability at any time, which may affect the Service without notice.
  • You acknowledge that apartment listings originate from third parties and that we bear no responsibility for their content, accuracy, or availability.

8. Alert Delivery

  • We strive to deliver alerts promptly but do not guarantee specific delivery times.
  • Alert delivery depends on third-party services (email providers, SMS carriers, Telegram).
  • Free plan alerts have a 15-minute delay compared to paid plans.
  • We are not responsible for missed alerts due to technical issues, carrier filtering, or incorrect contact information.
  • Alert limits are reset weekly based on your subscription plan.

9. SMS Alerts and Consent

  • SMS alerts are available on Premium plans and are powered by Twilio.
  • By providing your phone number and enabling SMS alerts, you expressly consent to receive automated text messages from AptAlert NYC. This consent is not required to purchase any service.
  • Message frequency varies based on your search criteria. You may receive multiple messages per day.
  • Standard message and data rates may apply.
  • You may opt out at any time by replying STOP to any message, disabling SMS in your account settings, or contacting us at sa.consultingaepllc@gmail.com.
  • Reply HELP for assistance.
  • We comply with the Telephone Consumer Protection Act (TCPA) and all applicable regulations governing automated text messages.

10. Email Communications and CAN-SPAM

  • By creating an account and setting up search profiles, you consent to receive transactional email alerts matching your search criteria.
  • We may also send occasional marketing or product update emails. You can unsubscribe from marketing emails at any time via the unsubscribe link in each email or through your account settings.
  • We comply with the CAN-SPAM Act: all emails identify AptAlert NYC as the sender, include a physical mailing address, and provide a clear opt-out mechanism.
  • Unsubscribe requests are processed within 10 business days.

11. Intellectual Property

The Service, including its design, code, logos, and content (excluding third-party listing data), is the intellectual property of SA Consulting AEP LLC. You may not copy, modify, distribute, or create derivative works without our written permission.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by law, SA Consulting AEP LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or opportunities, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless SA Consulting AEP LLC from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Account Termination

  • You may delete your account at any time from your account settings.
  • We may suspend or terminate your account for violation of these Terms.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.

  • Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation.
  • If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Arbitration shall take place in New York County, New York, or remotely at the claimant's election.
  • You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits or class-wide arbitration.
  • Notwithstanding the above, either party may seek injunctive relief in the courts of New York County, New York.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, third-party service failures (including Stripe, SendGrid, Twilio, Telegram, or listing source platforms), government actions, or other force majeure events.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
